What an Electronics Expert Witness Actually Does

The job is rarely a lecture on circuit theory. In litigation the work is concrete and evidentiary.

  • Read schematics, netlists, and printed circuit board layouts and state what the design does.
  • Compare an accused product against asserted patent claims, element by element, and give infringement or non-infringement opinions.
  • Tear down a physical product, photograph and document it, and connect what is inside to what the documents claim.
  • Analyze test data, oscilloscope captures, thermal images, and returned-unit failure reports.
  • Reconstruct a design history from revision control, engineering change orders, and lab notebooks.
  • Explain the standard of care an electrical engineer owed, and whether the design met it.

Most of these deliverables end up in a report, a deposition, and eventually testimony. An expert who can do the analysis but cannot write it plainly is only half useful, which is why we screen for both.

The evidence in an electronics case is more varied than in a pure software case, and it is often physical.

  • Hardware description language sources in Verilog and VHDL, plus synthesis and timing reports

The Hardware and Firmware Boundary

Modern electronics disputes rarely stay on one side of that line. A motor controller misbehaves because of a timing bug in firmware, not a fault in the power stage. A patent claim recites a hardware element that the accused product implements in software. A safety system fails because the watchdog was configured wrong.

This is the part of an electronics case that most often decides it, and it is where a firm that only fields circuit designers, or only fields programmers, will struggle. How to Evaluate an Electronics Expert Witness Firm

Attorneys ask us how we compare to the large expert-referral directories. That is a fair question, and the honest answer is that different models suit different matters. What we suggest looking for, whoever you engage:

  • Design experience, not just credentials. A professor who has published on semiconductor physics and an engineer who has shipped a product will give different testimony. Product liability and patent cases usually reward the second.
  • Someone who has been deposed before. A first-time expert with a perfect resume is a risk in a matter with real exposure.
  • Coverage of the whole product. Ask whether the same firm can also staff firmware, software, or safety expertise if the case moves that way.
  • A named human doing the matching. Keyword search against a database is not the same as an engineer reading the complaint.
  • Clarity on conflicts and availability before you invest time in a candidate.

In our experience the specification attorneys hand us first is often narrower than the case actually needs. The right expert for a power supply fire may be a thermal and packaging engineer rather than the circuit designer the complaint seems to call for. We would rather have that conversation early than place the obvious candidate and watch the opinion narrow under cross examination.

In practice that means a degree in electrical or computer engineering, years of hands-on design work in the relevant technology, and the ability to explain it clearly. Publications and patents help. Prior testimony experience helps more than most attorneys expect.

How is an electronics expert different from a software expert?

An electronics expert reasons about physical behavior: current, timing, heat, noise, and manufacturing tolerance. A software expert reasons about logic and code. Many modern disputes need both, and cases are lost when one expert is asked to opine outside their lane.
