Attorneys and Law Firm Clients
Collection
If you contact us seeking an expert witness, or engage us, we may collect: your name, firm, title, email address, phone number, and postal address; the details of your inquiry, including information about the matter for which you seek an expert; and the billing information needed to invoice for engaged experts. Our legal basis for the collection and processing of this data is the performance of our services and the steps taken at your request before entering an engagement.
Processing
We may use your Personal Data as follows:
- To identify and recommend suitable expert witnesses for your matter.
- To administer engagements, including invoicing and payment follow-up.
- To contact you with communications you have requested or agreed to receive from us.
Sharing
We treat your inquiries and expert searches as confidential. We do not disclose the details of your matter, even details available in public records, to any expert who has not entered into a subcontract with us. At most, we may identify to a candidate expert the name of a company that is a party to the matter, and if you tell us that your search is confidential, we will not disclose even that. Experts who have entered into a subcontract with us are bound by its confidentiality obligations.
Barr Group will not sell your Personal Data. We will not share your Personal Data with any third party except as stated in this Notice or as required to operate our business and provide our services to you, or otherwise as required or permitted by law.
Expert Witnesses
Collection
If you are an expert witness who works with us under a subcontract, or a candidate for our expert network, we may collect: your name and contact details; your curriculum vitae and professional credentials, including your education, employment history, publications, areas of expertise, and prior testimony; your rates and availability; and, if you are engaged through us, the payment and tax information needed to pay you (for example, Form W-9 and banking details). We may supplement this with information from public professional sources, such as court records, professional directories, and your published work. Our legal basis for the collection and processing of this data is the performance of our services and our legitimate interest in maintaining a network of qualified experts.
Processing
We may use your Personal Data as follows:
- To evaluate your qualifications and match you to litigation matters.
- To present your credentials to prospective clients, subject to the conditions described under Sharing below.
- To publish capability profiles on our website that do not name or directly identify you.
- To administer engagements, including invoicing on your behalf and paying you.
Sharing
We will not share your name or your curriculum vitae with any attorney or law firm unless all of the following are true: (a) you have entered into a subcontract with us; (b) you are not conflicted in the matter; and (c) you have agreed to be submitted for the specific matter. We may describe your qualifications to prospective clients in a form that does not name or directly identify you.
Barr Group will not sell your Personal Data. We will not share your Personal Data with any third party except as stated in this Notice or as required to operate our business and provide our services to you, or otherwise as required or permitted by law.
Referrals of Other Inquiries
Our business is expert witness services. If you contact us about services we do not provide, such as engineering training or consulting, we may refer you to a recommended alternative supplier. We make these referrals as an open introduction, by email with you and the supplier together, so that you can see what has been shared and choose whether to proceed. What we share is limited to your contact details and the substance of your inquiry.
Social Media
We maintain a company presence on professional networks such as LinkedIn. If you follow or interact with us there, the network makes certain profile information visible to us under its own privacy policy. We use it only to understand and communicate with our professional audience. We do not advertise, and we do not sell this information or combine it with other data about you.
Website Visitors
Collection
If you visit barrgroup.com ("our Website") the data transmitted from your web browser to our Website's logs may include your IP address, the date and time and length of your visit, the specific pages visited, your browser type and version, your operating system and version. Our legal basis for the collection and processing of this data is our legitimate interest in operating our website, providing you with access to the information you wish to view including about our services, and understanding the interests of potential customers.
Through your web browser, our Website may place one or more cookies on your computer. These cookies do not directly identify a specific person, though they may potentially identify your computer, browser, or related settings. You can disable cookies in your browser settings at any time by disabling, e.g., "Allow sites to save and read cookie data." However, disabling essential cookies may result in you no longer being able to use the entire functionality of our Website. In practice, our Website sets three cookies: two used by Google Analytics and one used by Cloudflare for security.
Google Analytics also places cookies on your computer, to enable Google to provide website owners (including Barr Group) to better understand how users use websites. Google's processing of this information is governed by Google's own privacy policy. Information generated by these cookies is transmitted directly to and stored by Google on servers in the United States. You may also refuse these cookies by selecting the appropriate settings on your browsers or using a browser plug-in such as a Google Analytics Opt-out Browser Add-on (https://tools.google.com/dlpage/gaoptout).
Our Website is delivered through Cloudflare, which processes visitor IP addresses and browser characteristics to protect the site against automated abuse.
If you submit our contact form, we collect the information you provide, including any details about your matter. We treat these submissions as confidential and process them as described in the section for attorneys and law firm clients above.
Processing
If you visit our Website we may use your Personal Data as follows:
- To provide and improve our Website content (e.g., by analyzing which pages are most useful to visitors).
- To understand the interests of the attorneys and experts who visit us (e.g., by analyzing the specific pages you visit).
- To collect site statistics.
Sharing
Barr Group will not sell your Personal Data. We will not share your Personal Data with any third party except as stated in this Notice or as required to operate our website or otherwise as required or permitted by law.
Data Retention
We keep Personal Data only as long as it is needed for the purposes described in this Notice, to maintain our professional network, to meet legal, accounting, and reporting obligations, and to establish or defend legal claims. When Personal Data is no longer needed, we delete it or anonymize it.
International Transfers
We are located in the United States, and the Personal Data we collect is stored and processed there. If you contact us from outside the United States, you understand that your Personal Data will be transferred to and processed in the United States, where we protect it as described in this Notice.
Your Rights
The following privacy rights apply under the GDPR. As a matter of policy, we extend these rights to everyone whose Personal Data we hold, wherever they are located, to the extent feasible and permitted by law.
